About Dr. Malte Köllner

Malte Köllner is founder and partner of the IP Prosecution law firm Köllner & Partner in Frankfurt / Main. He has extensive experience in advising and representing clients in patent, trademark and design law matters as well as employee inventor remuneration.

His patent law firm Köllner & Partner focuses mainly on drafting and filing patent applications as well as appeal proceedings, both nationally and internationally. The firm is particularly active in all “digital” inventions, including AI, computer-related inventions, automation systems technology including plants, drives or (signal) controllers, as well as global medical technology. 

Malte Köllner strongly supports the continuous development of global jurisprudence on inventions involving artificial intelligence, and represents AI pioneer Stephen Thaler in appeal proceedings before the Federal Patent Court and before the Federal Supreme Court on the AI-generated invention of DABUS.

He is known as a leader and regular author, speaker and commentator on this topic, as well as in the field of IP Valuation and IP Due Diligence. 

Since 2007, Malte Köllner has been a lecturer on patent valuation and IP due diligence at the Universities of Strasbourg and Maastricht and on international patent law at the Open University of Hagen.

His most important current cases include the appeal proceedings Thaler./. DPMA (BGH X ZB 5/22) and the patent invalidity proceedings Thermoplay ./. EWIKON (BpatG 4 Ni 1/23(EP)) and Sektkellerei Herres ./. Barokes (Federal Constitutional Court 2 BvR 421/13). 

Malte Köllner is also an expert concerning the PCT, he has been the author of the leading patent law handbook “PCT-Handbuch” (Carl Heymanns Verlag, 17 th ed. 2022) since the 1st edition. He is also the editor of the German journal “Mitteilungen der deutschen Patentanwälte”.

Malte Köllner studied physics and holds a PhD in physical chemistry. Malte’s case experience covers a wide range of technical fields, including artificial intelligence and machine learning, medical technology and biotechnology, lasers and optics, technical equipment and drives, robotics technology, computer-implemented or software-involving inventions.

Malte Köllner has an international network of contacts with other law firms and patent attorneys. He speaks German, English and French.

Malte Köllner has published papers concerning various aspects of intellectual property protection and held lectures in Germany and abroad. His professional emphasis is on prosecution and appeal proceedings.
