Rory Clarke is a partner in Kirklandâs Intellectual Property Litigation Team in London. He has extensive experience litigating technologies such as mobile telephones and infrastructure (UMTS, LTE and 5G), other radio systems (e.g. DMR and TETRA), internet connectivity, robotics and microprocessors. He also advises clients on SEP and FRAND policy more widely, including in relation to legislative developments such as the proposed EU SEP Regulation.
Rory acts on cases at first instance and on appeal. He is frequently involved in the wider strategic aspects of intellectual property litigation. He has significant experience acting as coordinating counsel for multijurisdictional matters, assisting clients to develop and implement their patent litigation strategies, leading settlement/licensing negotiations and advising on matters concerning confidentiality.
Rory frequently acts in complex global SEP/FRAND disputes on behalf of leading players in the telecommunications industry. He is currently litigating some of the most high-profile SEP/FRAND disputes before the English court including MediaTek v Huawei, and Samsung v ZTE. Past reported cases include Sisvel and Mitsubishi v Xiaomi, and Philips v TCL. Rory also advises clients on SEP and FRAND policy more widely, including in relation to legislative developments such as the proposed EU SEP Regulation.
