JUVE Patent’s Germany ranking 2022: an overview
On the eve of the UPC launch, the German patent market has once again gained momentum. Law firms and patent attorney firms are getting set to increase their appeal for cases at the new court, where one third of the judges will be German. For example, Simmons & Simmons brought in a team of patent attorneys from Isenbruck Bösl Hörschler, opting for a new mixed approach. Other firms are underscoring their strong market positions with advice in attention-grabbing patent disputes.
Hoyng ROKH Monegier has positioned itself ready for pharma actions on the side of BioNTech over mRNA technology. The leading boutique was up against other heavyweights in the German patent scene, in the shape of Bird & Bird for CureVac and Freshfields for Moderna, in one of the year’s highest-profile cases.
Meanwhile, Hogan Lovells is underlining its leading market position with advice to tech giants like Apple and Oppo. At the same time, smaller IP boutiques including Kather Augenstein for Ericsson and Arnold Ruess for Nokia alongside Bird & Bird are proving once again that they can hold their own in the market.
Technical expertise in demand
A key factor in companies’ hiring practices is how much experience advisors have in SEP and FRAND issues on the interface with antitrust law. Wildanger Kehrwald Graf v. Schwerin & Partner, Bardehle Pagenberg and Quinn Emanuel Urquhart & Sullivan all demonstrated this in their recent team expansions.
The fact that patent attorneys are also authorised to represent clients at the UPC is creating further movement in the advisory market.
