JUVE Patent

de Marcellus & Disser – France 2024

JUVE Comment

This small IP boutique led by the experienced, well-respected Emmanuel de Marcellus is known for its frequent litigation activity for small companies against market leaders or industry giants. This makes the practice a popular choice for clients who feel insufficiently seen by large firms or who rarely conduct litigation. One prime example is the litigation for inventor Ferid Allani as claimant against industry heavyweights Google and Apple in a suit involving the two companies’ mobile phone operating systems.

Competitors on the opposing side – who frequently, and in this example, come from large firms – praise the firm’s professionalism and litigation strength. This activity covers a broad technical spectrum ranging from telecoms, security and the defence sector to the automotive industry. The firm appears less frequently on the side of life sciences clients.

Strengths

Patent litigation and advice to clients in security and defence.

European set-up

The small national IP boutique is seen far less often in the French component of pan-European suits than competitors like Aramis. de Marcellus & Disser is not one of clients’ first ports of call for UPC cases either.

Strategically, the firm has decided to remain independent as a team of exclusively lawyers. On the one hand, this – like its size – limits the firm’s opportunities at the UPC. On the other, smaller clients who appreciate the compact team set-up in national lawsuits could hire the firm for the UPC for this very reason.
