InterDigital and Arnold Ruess win injunction against Disney

Disney may not use InterDigital's advanced video compression technology on its streaming platforms in Germany. The Regional Court Munich has issued an injunction against the US entertainment company. Earlier this year, InterDigital sued the Walt Disney Company in the US, Brazil and Europe.

According to a press release from InterDigital, the Munich Regional Court issued a decision on the merits, banning Disney from infringing EP 1 905 233 (case ID: 7 O 1297/25). InterDigital’s patent enables a method for dynamically overlaying a first video stream with a second video stream comprising, for example, subtitles. Disney can appeal the decision.

The Munich court’s judgment, follows a decision from a Brazilian court in parallel litigation to grant a preliminary injunction in InterDigital’s favour. The Brazilian court found that Disney infringed both of the InterDigital patents-in-suit.

InterDigital has also filed suits at the United States Federal District Court in the Central District of California (case ID: 2:2025cv00895) and the Unified Patent Court’s local divisions in Mannheim (case ID: UPC_CFI_445/2025) and Düsseldorf (case IDs: UPC_CFI_297/2025 and UPC_CFI_651/2025).

In Mannheim, the parties are disputing EP 2 465 265, EP 3 259 902, EP 2 080 349, EP 2 449 782, while the local division in Düsseldorf is dealing with EP 2 080 349. All patents protect technical aspects used in video streaming.

Earlier this year, InterDigital had applied for an Anti-anti-suit Injunction (AASI) at the UPC’s local division Mannheim as well as at the Regional Court Munich (case ID: Az 7 O 6397/25), aiming at preventing Disney from applying for an ASI. The US entertainment company, arguing that they had not intended to apply for an ASI, accepted the AASI.

Same but different

As in previous disputes, InterDigital is relying on a team of litigators from Arnold Ruess and patent attorneys from df-mp at both the UPC and the Munich Regional Court.

Both firms have already successfully represented the client in infringement and nullity actions against Oppo in Germany. Counsels Lisa Rieth and Jan Wergin assisted partners and renowned patent litigators Cordula Schumacher and Arno Riße of Arnold Ruess. Dual-qualified Dominik Ho and patent attorney David Molnia of Munich based df-mp provided technical advice. The Düsseldorf based IP boutique and Munich based patent attorneys are also representing InterDigital in a dispute against Amazon.

In the UPC proceedings as well as at the Regional Court Munich, IP boutique Pentarc is representing Disney. The team around well known litigators Dietrich Kamlah and Christian Lederer started the litigation while still being part of the German Taylor Wessing practice, but have since left the firm to form their own IP boutique at the beginning of October. The Pentarc team working on the case also includes partners Michael Schächinger and associate Verena Brusius.
