JUVE Patent’s Austria ranking 2023: an overview
With the launch of the Unified Patent Court imminent, the Austrian patent community is both enthusiastic and apprehensive. Vienna will play host to a local division around well-respected IP judge Walter Schober. While some patent experts are undoubtedly looking forward to playing a role in cases where Austrian matters arise, there are also concerns that the UPC might lead to a reduction in national cases.
Furthermore, some experts believe the robust local divisions in Germany might poach work from Vienna, especially if Austria’s local division is not accepted by clients.
These fears have led to some interesting developments in the Austrian patent market. Some Viennese patent law firms have chosen to shift their focus to soft IP and other practice areas, rather than establish solid teams in patent law. Many firms, however, are taking a wait-and-see approach when it comes to their business and strategies.
Although Austrian lawyers fear that national patent litigation in particular could decline in the future, in the two-year run-up to the UPC launch it has been stable. Austrian patent litigation firms are often involved in pan-European disputes in the life sciences sector. In contrast, mobile communication litigation does not play an important role at the Viennese patent court. National disputes focus primarily on mechanical and electronics patents, often related to the automotive industry.
