The integrated practice led by partner Georg Kresbach is well-regarded across all areas of IP. In patent litigation, the team representing clients in the Austrian portion of several economically significant pan-European patent proceedings. A current highlight is undoubtedly the work for Amgen on the defence strategy for a biosimilar in Austria and Eastern European countries, parallel to the first biosimilar case at the UPC.

In other fields of IP law, Wolf Theiss’s strength in advising platform companies and excellent international network make it a go-to firm for global tech companies. However, it is not only these firms that rely on the market-leading IT law and data protection team, as demand for advice has increased among other client groups due to new regulatory requirements such as NIS2, DORA, DSA and the AI Act. Some of these also impact long-running proceedings, such as those for client Meta against ORF.

The team represents its clients in court more frequently than comparable firms like Dorda or Schönherr. For instance, Roland Marko, particularly noted for his data protection law expertise, successfully had the €8 million fine imposed by the DSB on his client Rewe International overturned. The firm’s reputation also ensures a steady stream of clients in trademark law.

The firm suffered a setback with the departure of counsel Adolf Zemann, who was highly regarded in copyright law and established his own practice in 2025. Although Wolf Theiss avoided capacity issues by recruiting an experienced trainee from Schönherr in late 2024, the reputation that Zemann had built up has been lost.
