After the UPC recently dismissed its infringement claim against Google, Ona Patents suffered another defeat in the parallel national proceedings. The German Federal Patent Court revoked a patent related to the patent-in-suit from the UPC case.

At the centre of the national dispute lies EP 1 354 491. Finnish wireless solutions provider Ekahau originally filed the patent. Although the patent has already expired, the parties are fighting over damages related to infringement at Munich Regional Court (case ID: 7 O 3152/24).
In the parallel nullity proceedings, the Federal Patent Court has now revoked the patent in its entirety (case ID: 4 Ni 25/24). It is not yet known if the patent owner will appeal the decision to revoke the patent, however an appeal to the Federal Court of Justice is likely. During this time, the Munich court suspended the damages case.
In a parallel UPC action over a related patent EP 2 263 098, the Düsseldorf local division earlier this year rejected Ona Patents’ claim against Google.
Google once again banked on its go-to advisors from Quinn Emanuel Urquhart & Sullivan. The team led by partners Marcus Grosch and Jesko Preuß is conducting the nullity suit as well as the parallel infringement and damages actions in Munich. They also represent the client at the UPC, where they cooperate closely with in-house lawyer and head of patent litigation at Google, Ralf Uhrich.
Patent attorney Benjamin Bubendorfer defended EP 491 at the Federal Patent Court. He also provides technical advice in the parallel UPC proceedings, where the lawyers of Kather Augenstein are leading the case.
