Casalonga – France 2022
This well-established IP boutique stands out in patent litigation for its long-established, well-oiled team of lawyers and patent attorneys. While many competitors in the French market are only now starting to field mixed teams, the merging of technical and legal expertise in patent litigation is deeply anchored in Casalonga’s DNA. The patent attorneys are not only very active in EPO oppositions but are also frequently brought in by the lawyers for technical aspects when representing clients in infringement and nullity proceedings. Many of the patent attorneys thus boast years of experience in litigation – unlike their counterparts in many traditional patent attorney firms specialising in prosecution. Casalonga demonstrated how the team leverages this to its clients’ advantage in its litigation for Sagemcom in the high-profile multi-party suit against Intellectual Ventures. This involvement in what is probably the largest case of FRAND litigation in France right now is also a good chance to raise the litigation practice’s visibility in telecoms cases. Before now, the team’s renown was largely based on litigation for pharma clients. Regular client Biogaran banks on Casalonga in numerous ongoing suits in France against, among others, MSD. Zentiva also trusted in the firm in the dispute against Eli Lilly. The litigation team is active in other sectors as well, including cosmetics, medical devices and automotive suppliers.
The patent attorney team covers an even broader range of technical fields. This team raised its headcount once more and, independently from the close cooperation with the lawyers in patent litigation, gained recognition in the market for filing and prosecution. The patent attorneys are active, for example, for numerous clients from the life sciences, medical devices, transport, electronics and digital communications sectors.
Litigation for manufacturers of generic pharmaceuticals. Patent prosecution regarding pharma, biotechnology, digital communication, computer technology and electronics.
With cooperation between litigators and patent attorneys well established, Casalonga has a good basis for combined nullity and infringement proceedings at the UPC. The mixed team is especially experienced in pharma cases, including pan-European cases for Biogaran and Zentiva. Casalonga is present at the headquarters of the EPO in Munich with a small office of three patent attorneys but does not have any other patent experts outside of France. The firm does, however, have close contacts at patent attorney firms within the Eplaw network in Germany, the UK and the Netherlands among other places.
