Hogan Lovells – France 2021

The French team of this internationally well-positioned patent litigation practice is a challenger to the market leaders. Over the past year, the young team led by up-and-coming partner Stanislas Roux-Vaillard has won the market’s acclaim. Its success for Eli Lilly, a regular client across the whole firm, in two damages cases against generics manufacturers was among the most widely observed pharma decisions of the past year.

Winning a round for Astronics against Lufthansa has also brought Hogan Lovells a great deal of attention. Although competitors have long recognised the quality of work, this year really showed what a hard-hitting team Hogan Lovells has built up in Paris, as it successfully litigated for notable international clients in cooperation with other European offices.

Hogen Lovells is already a market leader in most other European patent jurisdictions. However, currently the firm lacks the headcount necessary to catch up in France. Because of the many pan-European cases, the Paris office has had less time to build up a client base of its own and transfer its own work to other Hogan Lovells offices. Some stand-alone instructions do reveal the potential this could harbour, however. The team therefore must continue its drive towards expansion. But the move of an experienced associate to an in-house team was a small setback on this path.

European strategy

Hogan Lovells is truly cross-border in litigation. Internationally, it is highly-visible in pharmaceuticals, mobile communications and electronics cases, for instance for Apple, Eli Lilly, HTC and Vodafone. The French team has an asset in its excellent partners and meets its own team-building expectations with success before the courts.

In Germany, Hogan Lovells belongs to the leading teams in the market; in the Netherlands and the UK the firm is a fierce challenger of the market-leading firms. The practice also has smaller but well-regarded teams in Milan and Madrid.

When it comes to building up a patent attorney practice across Europe, however, main competitor Bird & Bird is ahead. Hogan Lovells only began two years ago to expand its patent attorney arm in Germany. But it is far ahead of competitors such as Bird & Bird, Allen & Overy and Freshfields with regards to transatlantic work, thanks to its well-established US patent practice.
