About Dr. Thomas Gniadek

Thomas is a patent litigator and partner with Simmons & Simmons LLP based in Munich, Germany. His practice covers a broad range of technical fields spanning from telecoms, software, consumer electronics, IoT to automotive, mechanical engineering and biotech.

Thomas has successfully handled a large number of high-tech patent litigation cases for well-known clients from the US, China, Japan and Europe – both plaintiffs and defendants. He delivers impressive results in challenging cases.

In addition to his core patent litigation skills, Thomas has great experience with standard essential patents (SEP) and anti-trust issues (FRAND), including coordination of a global FRAND strategy and anti-suit-injunctions/anti-anti-suit-injunctions (ASI/AASI).

In the JUVE handbooks 2019/2020 and 2020/2021, Thomas is ranked as a “frequently recommended lawyer”. Clients note that he is “very good, so we will keep working with him in his new firm”, and they appreciate his “assertive litigation style”. Competitors describe his negotiation-style as “pragmatic and solution-oriented”. In the respective ranking of the WirtschaftsWoche 2019, Thomas is listed as one of the “most renowned patent law attorneys in Germany”. Further listings: The Legal 500 and The Legal 500 Deutschland.

Further, Thomas advises on technology related know-how and trade secret protection. He has handled one of the first trade secret litigation cases in Germany based on the new Trade Secret Act (Geschäftsgeheimnisgesetz).

Thomas knows what it takes to win. For doing so, he uses the specific legal features of the German and the European patent system for the benefit of his clients. He is very client-focused and forms collaborative teams with the clients’ inhouse counsels and technical experts in order to learn and access the knowledge and experience which is already present with the client.

His practice includes helping clients manage risks and arriving at practical solutions without involving the courts. He has a wealth of experience in providing comprehensive freedom-to-operate (FTO) and clearance analyses. And he advises and represents his clients in complex out-of-court negotiation scenarios.
